TERMS AND CONDITIONS

 

These terms and conditions apply between you and Leapkids Australia Pty Ltd (Leapkids). By enrolling your child with Leapkids, you indicate your agreement to be bound by all these terms and conditions.

References in these terms and conditions to ‘us’, ‘our’ and ‘we’ means Leapkids. References to ‘you’ and ‘your’ apply to the custodial parent, legal guardian or care giver. Unless specified, these terms and conditions apply to Leapkids before and after school care services and school holiday programs.

 

1. ENROLMENT & AUTHORISATION

 

1.1 You confirm that you are the parent or legal guardian of the enrolled child, and the information provided on your child’s enrolment is complete and accurate (including medical conditions, dietary requirements, emergency contacts, authorised nominees). Failure to disclose relevant information may result in your child being suspended or excluded from our service.

 

1.2 It is your responsibility to ensure that Leapkids is made aware of any court orders regarding contact with your child (including family court orders, parenting orders, family violence-related orders, child protection orders and bail orders). If these orders exist, we cannot honour the booking until the relevant orders are received prior to your child’s attendance. You are responsible for immediately informing Leapkids of any changes to custody and access arrangements. Leapkids cannot accept court orders with portions removed, omitted or redacted.

 

1.3 A minimum of 4 weeks’ notice is required for children diagnosed with any form of medical condition, learning or behavioural disorder and require additional support. This is to allow adequate time to apply for additional funding and arrange appropriate support. Applications for children with additional needs received less than 4 weeks’ will not be processed.

 

1.4 Your child will not be permitted to leave our service with anyone other than those authorised on the child’s enrolment, or with written authorisation from the custodial parent or legal guardian.

 

1.5 You must notify Leapkids if your child is going to be absent, and agree that failure to notify your child’s absence may result in you being liable to pay the applicable session fee in full (without child care subsidy).

 

1.6 Leapkids will not permit any child to attend our service without an enrolment or prior confirmed booking, irrespective of the circumstances.

 

2. DELIVERY & COLLECTION

 

2.1 Leapkids duty of care starts when the child enters the premises and is signed in by a parent, guardian or authorised nominee on the child’s enrolment. The duty of care ends when the child is signed out by a parent, guardian or authorised nominee on the child’s enrolment.

 

2.2 Children will not be allowed into enter our service before the official opening hours.

 

2.3 Children are not permitted to sign themselves in or out of our service. Leapkids reserves the right to refuse requests for alternate sign-in procedures from the child’s parent or legal guardian.

 

2.4 Children will not be released to a person not listed as an authorised person or nominee on the child’s enrolment.

 

2.5 Children will not be allowed to leave our service with any person visibly under the influence of drugs or alcohol.


2.6 Children may be released into the care of a person because of an emergency or when the child requires medical, hospital or ambulance care.

 

3. CHILD CARE SUBSIDY (CCS)

 

3.1 If you intend to claim child care subsidy (CCS), you must provide Leapkids with correct parent and child details matching the information provided to Centrelink (including CRNs, names and dates of birth). You are liable for paying full fees and charges until Leapkids can verify your CCS entitlement.  If you have questions about your Centrelink entitlements, contact Department of Human Services Family Assistance Office on 131650.

 

3.2 You are responsible for confirming your Certified Written Agreement (CWA) through your MyGov account. This is required in order to receive your child care subsidy.

3.3 Please note CCS is only paid from the first or last day of attendance during any 14-week or enrolment period. Any CCS paid outside of this period may be revoked by Centrelink and reflected on the parents’ account. Please note this can take up to 3 months as Centrelink reconcile quarterly. In this instance, families will be required to pay the CCS portion already paid for absences prior to the first day and/or after the last day of attendance. 

 

4. FEES & CHARGES

4.1 Before and after school fees are published in your parent handbook. Holiday care fees are currently set at $125.00 per excursion, $110.00 per incursion and $95.00 for a standard day.

 

4.2 Holiday care fees are projected and direct debited to your nominated account, prior to the start of the holiday program. Non-payment of the projected fees prior to the start of the program will result in your application being cancelled. If for any reason Centrelink does not pay your holiday care fees, then you will be liable to pay the full fees for using our service.

 

4.3 You agree to comply with our direct debit payment method, and understand that your application will not be processed without an online direct debit registration.

 

4.4 You consent to Leapkids direct debiting your fees from your nominated bank account fortnightly. A statement will be emailed to the account holder prior to any direct debit being processed.  

 

4.5 All direct debit payments to Leapkids are deducted by Zenpay Pty Ltd, trading as Childcare EasyPay (external payment provider), and any additional fees and charges applied by Zenpay are not charged by Leapkids (including $0.90c per direct debit transaction, 1.34% for Mastercard, 1.54% for Visa and 1.86c for AMEX and $9.90 dishonour fee).

 

4.6 A late collection fee of $2.00 per minute (rounded down to whole minute) will apply if your child is collected after the service closing time (i.e. 6:00 pm).

 

4.7 A late payment fee of $15 per billing cycle for each billing period your account remains unpaid.

 

4.8 A debt collection recovery fee of 25% of the outstanding debt amount, in the event a debt recovery agency is commissioned to recover your outstanding debt.

 

5. CANCELLATIONS

 

5. 1 Before and After School Care

5.1 (a) Cancellation to a confirmed booking made via email 48 hours from the session start time will not incur the applicable session fee.

5.1 (b) Cancellation to a confirmed booking made via email within 48 hours from the session start time with a medical certificate will not incur the applicable session fee.

 

5.1 (c) Cancellation to a confirmed booking made via email within 48 hours from the session start time without a medical certificate will incur the applicable session fee.

 

5. 2 Vacation Care (School Holiday program)

 

 5.2 (a)     Cancellation to a confirmed booking made via email after the last day of term will incur the applicable session fee in full charged per child, per day.

 

6. REFUNDS & CREDITS

 

6.1 Once the holiday program starts, refunds or credits will not be issued for absences or unsuspected illnesses or injury, including COVID-19 related illnesses.

 

6.2 Leapkids is under no obligation to refund or offer credit for a confirmed session your child does not attend.

 

6.3 Leapkids reserve the right to discretion on all decisions concerning refunds and credits.

 

7. HEALTH & MEDICAL

 

7.1 You give permission for Leapkids staff to administer appropriate medical attention and first aid in the event of an accident, incident or illness, and authorise Leapkids staff to seek and obtain all necessary medical assistance and treatment for your child. You are liable for, and agree to meet any relevant related medical expenses.

 

7.2 If your child suffers from anaphylaxis, asthma, allergies or any medically diagnosed condition, you undertake to provide a current medical management plan, anaphylaxis management plan or risk minimization plan signed by your doctor with a recent colour photo of your child. 

 

7.3 If your child has an Action Plan that requires an EpiPen to be administered, you must provide your own EpiPen to our service.

 

7.4 If your child is diagnosed as having Asthma and the Action Plan requires a Ventolin to be administered, you must provide your own Ventolin to our service.

 

7.5 Leapkids staff can only administer medication prescribed by a doctor, and cannot administer non-prescription drugs or dietary supplements, unless we are provided with written authorisation by a doctor.

 

7.6 Medication can only be administered to a child by Leapkids staff from its original packaging with a pharmacy instruction sticker.

 

7.7 if you require Leapkids staff to administer medication to your child, you are responsible for giving the medication to Leapkids staff for safe storage, and completing a medication authorisation form when you drop off your child at our service. You must ensure that you do not leave medication in your child’s bag under any circumstances.

 

7.8 You will ensure that your child does not attend our service if suffering from an infectious or contagious disease as identified by the Department of Health.

 

8. EXCURSIONS

 

8.1 You acknowledge that you have read the Excursion Information published on the Leapkids website including departure/arrival times, planned activities, mode of transport, period the child will be away from the service and number of staff attending.

 

8.2 You agree that you must authorise your child to participate in excursions organised by Leapkids. Your child will not be permitted to participate in an excursion without your prior written authorisation on the Leapkids Excursion Authorisation Form, which will be available at the service on the day of the excursion.

 

8.3 You consent to Leapkids signing on your behalf disclaimer forms which may be required for specific excursions (e.g. assumption of risk, waiver and indemnity forms).

 

8.4 You agree to drop-off your child at the service no later than 9:00am, unless otherwise published on the Leapkids Website under Excursion Information. In the event you miss the bus (I.e. departure from the service) you will not be permitted to drop-off your child at the excursion venue, and marked absent.

 

8.5 You take full responsibility for any loss or damage to any personal belongings which your child may bring to a Leapkids excursion.

 

 

9. PARENT, CARERS & VISITORS CODE OF CONDUCT

 

9.1 Parents, carers and visitors to our service support safety by ensuring their communication and conduct at our service is respectful to children, staff and the company. It is expected that parents, carers and visitors will be polite to others, act as positive role models, recognise and respect personal differences, work together with our staff to resolve issues or concerns, respect people’s privacy, speak positively about the company and our staff and not gossip or make negative comments about other children, parents, staff or the company including in person, in writing or on social media.

 

9.2 Parents, carers and visitors are expected at all times to treat company information as private and confidential and not disclose, share, circulate or disseminate personal information about other children, parents, staff or Leapkids that may discredit and undermine the company’s integrity or reputation including in person, in writing or on social media.

 

9.3 Breaches of this Code of Conduct will result in the company taking such action as is appropriate to protect the safety and wellbeing of children, staff and the integrity and reputation of the company. This may include asking parents, carers or visitors to immediately leave our premises and contacting the police for assistance in situations where a person refuses to leave our service, suspending or cancelling a child’s enrolment or and taking legal action against a person or entity to protect the integrity and reputation of the company.

 

10. ADDITIONAL TERMS AND CONDITIONS

 

10.1 You accept that your child may be suspended for a period of time or excluded from our service, if he/she displays behaviour that is considered inappropriate, threatening or dangerous to themselves and/or others. In the event your child is suspended or excluded, you must immediately collect your child from our service. Leapkids reserve the right to disclose your child’s name and reasons for suspension or exclusion to the school Principal.

 

10.2 Appropriate clothing and footwear – you will ensure that your child wears suitable clothing for the weather and suitable footwear (I.e. closed-toe shoes). Please ensure that your child does not wear sandals or thongs to our service.

 

10.3 Food and nutrition – you will ensure that your child brings a morning snack, packed lunch and water bottle for holiday care. For the protection of children at our service who have nut allergens, we ask that you do not send food with your child that contains nuts or nut derivatives.

10.4 Sunscreen – you authorise Leapkids staff to apply sunscreen on your child, unless you have specified otherwise on your child’s enrolment and provided your own. Your child may not participate in outdoor activities unless he/she wears a wide-breamed hat provided by you during the sun protection period, from September until the end of April.

10.5 Personal belongings and electronic devices – personal items and electronic devices are not permitted at our service (such as toys, games, mobile phones and tablets). You take full responsibility for any loss or damage to any personal belongings or electronic devices your child brings to our service.


10.6 Films and movies – you give permission for your child to occasionally watch G and PG rated films and movies while attending our service.

 

10.7 Photographs, videos and media – you authorise Leapkids to use photographs and videos taken of your child within Leapkids programs through visual displays and newsletters, and consent to Leapkids using photographs and videos of your child for marketing and advertising of Leapkids programs and services. It is your responsibility to notify Leapkids in writing if you do not consent to Leapkids using photographs and videos of your child for the aforementioned purposes.

 

10.8 You agree that Leapkids does not accept any liability for personal injury, property damage or loss sustained by any child attending our service. You will be liable for the costs and repairs in the event your child deliberately damages property and equipment.

 

10.9 Privacy – Leapkids has procedures and practices in place to ensure that personal information is protected in accordance with the Australian Privacy Act 1988.

 

 DISCLAIMER

Leapkids reserves the right, in its sole discretion, to change the Terms and Conditions under which our programs and services are offered. The most current version of the Terms and Conditions will supersede all previous versions. Leapkids encourages you to periodically review the Terms and Conditions to stay informed of our updates. Your usage of our programs and services and any published change in these Terms and Conditions is your express agreement with Leapkids that you will be bound by each of the modified Terms and Conditions.
